Terms for the Casaya private beta.

These terms explain the rules, responsibilities, and limitations that apply when you create an account or use Casaya.

Private beta legal notice

This document is a good-faith operating draft for Casaya's United States private beta. It should receive qualified legal review before a broad public launch.

1. About these terms

These Terms of Use govern your access to Casaya, a household life-admin service operated by an individual operator under the name Casaya. By creating an account or using the service, you agree to these terms and the Privacy Policy.

Casaya is currently offered as a private beta in the United States. You must be at least 18 years old and able to enter into a binding agreement to create an account.

2. Private beta service

The beta may contain errors, interruptions, incomplete features, or inaccurate results. Features may change or be discontinued, and access may be limited, suspended, or withdrawn at any time.

Casaya does not guarantee that the service will always be available or that every forwarded message will be received, processed, or interpreted correctly.

3. Your account and responsibilities

You are responsible for maintaining the security of your account, providing accurate information, and promptly notifying Casaya if you believe your account has been compromised.

You remain responsible for reviewing Casaya's results, confirming important dates, amounts, instructions, and recipients, and completing commitments on time. Do not rely on Casaya as the sole record for urgent or important matters.

4. Forwarded information

When you forward an email or text, you authorize Casaya to process it to provide the service. You represent that you have the right to share and process the information and that your use does not violate another person's rights or applicable law.

Do not submit information that you are prohibited from sharing. Casaya is intended for ordinary household administration and is not designed as an emergency, medical-record, legal-record, or financial-record system.

5. No professional advice

Casaya organizes information and identifies possible commitments. It does not provide medical, legal, financial, insurance, tax, or other professional advice.

Casaya's output should not replace original source materials, professional guidance, or your own judgment.

6. SMS consent

If you enable text forwarding, you agree to receive account-related SMS from Casaya, including phone verification and SMS processing notices. Message and data rates may apply. Reply STOP to disable SMS processing or HELP for help.

Casaya does not send marketing messages through this beta SMS workflow. SMS processing is enabled only for a phone number you verify.

7. Acceptable use

You may not use Casaya to violate law, harm another person, infringe rights, distribute malicious software, probe or disrupt the service, bypass access controls, submit information without authorization, or use the service for unlawful surveillance or harassment.

You may not resell, reverse engineer, scrape, or make automated high-volume use of the service except where applicable law does not permit that restriction.

8. Ownership and feedback

You retain your rights in information you submit. You grant Casaya the limited rights necessary to process that information and operate the service.

Casaya and its licensors retain rights in the service, software, branding, and documentation. If you provide feedback, Casaya may use it without restriction or compensation, provided it is not publicly attributed to you without permission.

9. Suspension and termination

You may stop using Casaya at any time and may request deletion of your household data. Casaya may suspend or terminate access for security, legal, operational, or acceptable-use reasons, or when the private beta ends.

Terms that by their nature should continue after termination, including ownership, disclaimers, liability limits, and dispute provisions, will continue.

10. Disclaimers

To the fullest extent permitted by law, Casaya is provided "as is" and "as available." Casaya disclaims implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and warranties arising from course of dealing.

Casaya does not warrant that results will be accurate, complete, timely, secure, or uninterrupted. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.

11. Limitation of liability

To the fullest extent permitted by law, Casaya and its operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, profits, opportunities, or goodwill arising from the service.

Casaya's total liability for claims relating to the service will not exceed the greater of the amount you paid Casaya during the twelve months before the claim or 100 US dollars. These limits do not apply where prohibited by law.

12. Disputes and governing law

Before filing a claim, you agree to contact Casaya and attempt to resolve the dispute informally for at least 30 days. These terms are governed by applicable United States law and the applicable law of the state where the operator resides, without regard to conflict-of-law rules.

Any dispute that cannot be resolved informally must be brought in a court with jurisdiction over the operator, unless applicable consumer law gives you the right to bring it elsewhere.

13. Changes

Casaya may update these terms as the beta changes. Material updates will be posted with a new effective date and, when appropriate, communicated through the service or by email. Continued use after an update means you accept the revised terms.
